Daily Law Tips (Tip 429) by Onyekachi Umah, Esq., LLM. ACIArb(UK)
QUORUM FOR STATES CIVIL SERVICE COMMISSIONS, STATES INDEPENDENT ELECTORAL COMMISSIONS AND STATES JUDICIAL SERVICE COMMISSIONS.
Every state in Nigeria has Civil Service Commission, Independent Electoral Commission and Judicial Service Commission. They are state executive bodies created by the constitution of the Federal Republic of Nigeria.
The quorum (number of members that must be present before meetings and decisions can be held) for each of the bodies is not less than one-third of the total number of members of that body at the date of the meeting.
Until there is quorum such bodies cannot hold meetings and take decisions.
Note that this is a constitutional provision and cannot be waived, changed, altered or varied by any person, member, government or law. It can only be changed through amendment of constitution of the Federal Republic of Nigeria.
My authorities are sections 197, 203(1), 318 and 319 of the Constitution of the Federal Republic of Nigeria, 1999.
