A federal high court in Kaduna on Monday entertained documents tendered by counsel to Jamilu Auwalu Adamu (plaintiff), a Ph.D of the Ahmadu Bello University (ABU), Sule Shuaib who is challenging his unlawful withdrawal from the institution.
In a special bulletin of ABU made available as part of the plaintiff’s reply to the defendants joint statement on defence and defense to counter claim, the institution noted that deadline for postgraduate registration for 2014/2015 session closes on Monday May 10th, 2015.
However, in a list of registered students for the academic session under review signed by Dr. Abubakar Yahaya (2nd defendant) and Professor Babangida Sani (3rd defendant) both of the Department of Mathematics of the university as Major and Minor supervisors respectively, five other students were registered after the closing date.
The court document claims. “The plaintiff pleads that he received numerous awards and prizes including best level 1 and level 11 students mathematics 2002 and 2003, the Bayero University prize for best level 111 mathematics 2004 to 2005, Dr. Saeed Ul-Islam price for best graduating student 2006, Governor Ibrahim Shekarau prize for best graduating student 2006.
“The plaintiff is the best graduating student in his master’s degree with CGPA of more than 4 in a scale of 5. The plaintiff published 12 international journals to his credit out his Ph.D research work thereby internationally inventing Jameel’s Critereon, Jameel’s Advanced stressed models and non-normal stocks Brownian motion that no one else in the whole world can claim which could be found on Google and Google scholar.
“The plaintiff in further denial of paragraph 30 of the statement of the defence claims states that in accordance to the American Psychology Association (APA) publication manual, fifth edition pages 350 to 351 stated that authorship reserved for persons who receive primary credit and hold primary responsibility for the published work. Authorship encompasses those who have made substantial scientific contribution to a study.”
However, memorandum of conditional appearance filed by counsels to the 1st Defendant, ABU, A. Is’haq Esq and Abubakar Sulieman Esq on October 23rd, 2017 argued that the plaintiff’s claim that the article entitled: “Reliable and Sophisticated Advance Stress Compounding Engineering Chaotic Models” does not exist on Google scholar
They urged the court to dismiss the plaintiff’s claim as same is without merit and the defendants counter-claim against the plaintiff for the reason aforementioned and pay N2 million for general damages, cost of filing the suit and defendants solicitors fee.
Counsel to the plaintiff, Sule Shuaib urged the court to adjourn the case saying, “Some of the documents I had wanted to tender are not in the state I could tender. I had wanted to take a second witness but he is under the weather and could not come with me. I will open and close my defence on the next adjourned date.
The presiding judge, Justice Shuaib Salah adjourned the matter to 19th March, 2018 for hearing.
