The Hon. President of the National Industrial Court, His Lordship, Hon. Justice Benedict Bakwaph Kanyip, PhD, FNIALS has issued practice directions, exempting payment of default fees for filing processes in the Court for the period of the JUSUN strike being from 6th of April to 14th of June 2021.

Justice Kanyip issued the directions in the exercise of the powers conferred on him by Section 254F(1) of the Constitution of the Federal Republic of Nigeria, 1999 as amended and Section 36 of the National Industrial Court of Nigeria (Civil procedure) Rules 2017.

His Lordship stated that the practice directions shall come into effect from Tuesday, the 15th day of June 2021

NATIONAL INDUSTRIAL COURT OF NIGERIA (EXEMPTION OF PAYMENT OF DEFAULT FEES FOR PROCESSES FOR THE PERIOD OF THE JUSUN STRIKE FROM 6 APRIL 2021 TO 14 JUNE 2021) PRACTICE DIRECTION (NO. 1) 2021.

EXPLANATORY NOTE:
a. WHEREAS by the reason of the strike action by the Judiciary Staff Union of Nigeria (otherwise known as JUSUN) which affected Court proceedings and filing of processes in the Court for the period from 6 April 2021 to 14 June 2021

b. AND WHEREAS it has become expedient to make Practice Direction to provide for the payment of default fees for extension of time for filing of processes in the National Industrial Court of Nigeria for the above mentioned period.

PREAMBLE:

In the exercise of the powers conferred on me by Section 254F(1) of the Constitution of the Federal Republic of Nigeria, 1999; Section 36 of the National Industrial Court Act, 2006; Order 1 Rule 8 (3) of the National Industrial Court of Nigeria (Civil Procedure) Rules, 2017 and all other powers enabling me in the behalf, I, Benedict Bakwaph Kanyip, PhD, FNIALS, FCArb, President of the National Industrial Court of Nigeria, do hereby issue the following Practice Directions:

1. COMPUTATION OF TIME:
Notwithstanding the provisions of Order 57 Rule 5 (6) of the National Industrial Court of Nigeria (Civil Procedure) Rules, 2017, the period covering the JUSUN strike action, being from the 6th day of April, 2021 to the 14th day of June, 2021 is hereby exempted.

2. APPLICABILITY:
These Practice Directions shall, save to the extent or may be otherwise directed by the Honourable President, apply to all causes and matters in the National Industrial Court of Nigeria.

3. CITATION:
These Practice Directions shall be cited as the National Industrial Court of Nigeria (Exemption of Payment of Default Fees for Filing of Processes) Practice Directions (No. 1) 2021

Commencement
These Practice Directions shall come into effect from Tuesday, the 15th day of June, 2021.
