Daily Law Tips (Tip 453) by Onyekachi Umah, Esq., LLM. ACIArb(UK)

*NIGERIA CUSTOMS OFFICERS HAVE SAME POWERS AS NIGERIA POLICE OFFICERS. *

Nigeria Police Force is a creation of the Constitution of Nigeria. Nigeria Police Force is established for prevention and detection of crime, apprehension of offenders and protection of lives and property. The Police can arrest with or without warrant. Police officer can detain a suspect. Police officer in charge of a police station can grant bail to detained persons that was arrested without warrant for not serious offences even when investigation is still ongoing. These and more are powers of officers of Nigeria Police Force.

The Nigeria Customs Service is established for and charged with the duty of controlling and managing the administration of the customs and excise laws and collection of the revenues of customs and excise and accounting for them. By the establishing Act of Nigeria Customs Services and for the enforcement of same, all officers of Nigerian Customs Service have all powers, authorities and privileges given by law to officers of Nigeria police.

My authorities are:
1. Sections 3, 4, 24, 25, 27 and 29 of the Police Act
2. Sections 4(1) and 8 of the Customs and Excise Management Act, 2003
3. Sections 11, 214, 318 and 319 of the Constitution of the Federal Republic of Nigeria, 1999.
