NGO sues the Clerk of the National Assembly and Speaker of House of Representatives for failure to present the Digital Rights Bill to President Buhari for his assent. The Incorporated Trustees of Laws and Rights Awareness Initiative has dragged the Clerk of the National Assembly and the Speaker of House of Representatives to Court over failure to present the Digital Rights Bill to President Muhammadu Buhari for his assent as required under sections 2 and 3 of the Acts Authentication Act. In Suit No. FHC/ABJ/CS/993/2018, filed by their lawyer Olumide Babalola at the Federal High Court sitting in Abuja, the Plaintiff seeks an order granting them leave to apply to the Federal High Court for judicial review of the refusal and/or omission of the Clerk and Speaker of the house of reps to accede to the Applicant’s request contained in letters dated 10th September 2018 for them to perform their administrative duty under sections 2 and 3 of the Acts Authentication Act. The Plaintiff suit also intends to seek a. A DECLATION that by virtue of section 2(1) of the Acts Authentication Act, after the enactment of the Digital Rights Bill in March 2018, the 1st Respondent ought to have prepared and certified a copy of the Digital Rights and Freedom Bill as provided by the section. b. A DECLARATION that by virtue of section 2(2) of the Acts Authentication Act, upon the enactment of the Digital Rights and Freedom Bill, the 2nd Respondent ought to have directed the 1st Respondent to prepare the Schedule of the Digital Rights Bill for onward presentation to the President of the Federal Republic of Nigeria for his assent. c. A DECLARATION that by virtue of section 3 of the Acts Authentication Act, after the enactment of the Digital Rights and Freedom Bill in March 2018, the 1st Respondent ought to have signed the schedule and presented it to the President of the Federal Republic of Nigeria for his assent. d. AN ORDER OF MANDAMUS compelling the 2nd Respondent to forthwith direct the 1st Respondent to prepare the Schedule of the Digital Rights and Freedom Bill for onward presentation to the President of the Federal Republic of Nigeria for his assent. e. AN ORDER OF MANDAMUS compelling the 2nd Respondent to forthwith prepare, certify a copy of the Digital Rights and Freedom Bill and present it to the President of the Federal Republic of Nigeria for his assent. The suit which is however yet to be assigned to a judge as at press time was filed on the heels of the Clerk’s refusal to perform his administrative function after the enactment of the Digital Rights and Freedom Bill into law since March 2018.]]>
