My name is Mrs. Gloria Odibei-Cassius, 14 years at the bar and a bonafide member of NBA, Ikorodu Branch and the welfare secretary of the branch in 2016. Sequel to a similar situation in the 2016, I was wrongfully disqualified by the then Electoral Committee from contesting for the office of SOCIAL SECRETARY. The reasons given for my disqualification was that there was alteration on the date of my Branch Receipt, which in their thinking, indicated that I did not actually pay my Branch Bar Dues at and when due in 2016 and that one of my sponsors – Mr. S.O.K Shillings Esq., a former NBA branch Chairman of over 20 years at the bar was not known to them as a Lawyer.

The fact of the matter remains that the then Financial Secretary- Mr. Babatunde Osoba who received my branch dues (in cash as was then applicable) on the 23rd of March, 2016 remitted same to the Treasurer, Mrs. Charity Fagade at the general meeting of 4th of April, 2016, a date which reflected on the Receipt as the date of payment. As the Treasurer’s attention was drawn to the fact that the money was paid since 23rd of March inst, she immediately effected the correction and reasonably countersigned on the receipt. In view of this, Mrs. Fagade did not only own up to that, she and the then Financial Secretary, Mr. Babatunde Osoba had separately deposed to an Affidavit to that effect.

My wrongful disqualification in 2016 prompted my petition to the National Body and a diligent investigation into the matter was carried out by the 2016 NBA Election Monitoring Committee which resolved thus; “Mrs. Gloria Cassius who was disqualified from contesting as Social Secretary is qualified to contest the election and the reason for her disqualification IS NOT TENABLE”.

Following this recommendation, I decided to contest the 2018 Branch elections, and having fulfilled all statutory requirements, I contested for the position of Branch Vice Chairman with one Mr. Ezekiel Ogbaide. Surprisingly and strangely, the said Mr. Ogbaide who had initially obtained form for the position of Branch Secretary but later changed his mind on the whimsical advice of his godfathers and decided to contest for the position of Vice Chairman with me. But funny enough, the so called godfathers were afraid to present their candidate in a free and fair contest hence, their resolve to manipulations to ensure that their anointed candidate emerge WINNER and UNOPPOSED.

In their desperate effort to achieve their aim, they resorted to threat, blackmail, and even physically assaulted me. When it became obvious that they would not succeed in their mischief, they resurrected the dead issue of the alteration in the 2016 Branch Dues Receipt; an issue that had been settled and confirmed NOT TENABLE by a superior authority. They accused the 2018 Electoral Committee headed by reputable senior colleague, Mr. Olumide Otayomi of bias and favouritism; prompting the setting up of Branch Election Monitoring Committee to look into the matter. This Monitoring Committee summoned all parties including the Electoral Committee Chairman to the Ikeja Bar center.

In that meeting, the Electoral Committee Chairman narrated to the Monitoring Committee how one Mr. Kazeem Adebanjo, Mr. Dotun Olatunji and Mr. Ezekiel Ogbaide had on several occasions prevailed on him to disqualify Mrs. Cassius to enable the said Mr. Ogbaide to run unopposed. He further averred that he had repeatedly told them categorically that his conscience would not allow him to betray an innocent person. The Monitoring Committee however, rose from the meeting, resolving that I had no case, adding that they cannot seat on appeal for a matter which the National Body had taken a decision in 2016.

Surprisingly again, the same Election Monitoring Committee made a u-turn and in their Report, disqualified me; claiming that though I was cleared on the same issue in 2016, that no documents was tendered to authenticate my claims. They however requested for the said documents to be presented to them on a particular date, which I did. On sighting the documents, they summoned the then Financial Secretary, Mr. Babatunde Osoba, the then Treasurer, Mrs. Charity Fagade and Islamiyyat Adesola, the then Publicity Secretary for more clarification on the matter.

Satisfied with their respective submissions, the Chairman of the Monitoring Committee, Mr. Adetowubo Kunle Esq, on the floor of the General Meeting of 25th June, 2018 and in the presence of the Committee Secretary, tendered an unreserved apology for unlawfully disqualifying me and rescheduled the election for the 28th June, 2018.

It was to our amazement, come 28th June, 2018; the Monitoring Committee refused to show up for the election, leaving the branch Electoral Committee with no option than to conduct the election which was indeed adjudged to be free and fair. In that election fully participated by the opponents, I was elected Vice Chairman along other elected branch officers.

Subsequently, the factional group of Dotun Adetunji Esq., Nurudeen Ogbara Esq., Kazeem Adebanjo and Ezekiel Ogbaide collectively petitioned the National body through the then General Secretary, Mr. Isiaka Olagunju, alleging that the election was not free and fair election. Consequently, a 3-member Caretaker Committee headed Mr. Bisi Ade-Ademuwagun Esq. was set up with the mandate to conduct a fresh and credible election in the branch.

On assumption of office, the Caretaker Committee was also confronted with the same issue of alteration of Branch Receipt, and seriously prevailed upon them to disqualify me. I was subsequently summoned to appear before the Committee to clarify myself and also, the then Treasurer, Mrs. Charity Fagade was also requested (on phone made personally to her by the Caretaker Committee Chairman) to depose to a SWORN AFFIDAVIT to the effect that she actually countersigned on the Branch Receipt.

Mrs. Fagade did not hesitate as she immediately obliged to that directive and deposed to an Affidavit dated 23rd July, 2018 and same was presented to the Caretaker Committee.

At this juncture, the Committee, having no further excuse and sufficiently satisfied with my submission on the issue, cleared me with my name appearing on number two (2) in the list of candidates for the 2018 election of officers, signed by the 3-member Caretaker Committee.

On the 25th July, 2018, while the election was ongoing at about 11 am; the same Caretaker Committee handed me a Disqualification Notice, citing the same reason for which I had been previously cleared by the same Caretaker Committee; an afterthought obviously instigated by some forces from the so-called factional group. The Caretaker Committee however, bowed to pressure and unlawfully disqualified me while my opponent, Mr. Ezekiel Ogbaide was returned UNOPPOSED, in breach of my fundamental Human rights as well as all known principles of civilized contest.

In view of the foregoing, I forwarded a petitioned to the newly elected NBA Branch Chairman, complaining of my unlawful disqualification from contesting the 2018 NBA Branch Election. My petition dated 26th July, 2018 was read in the General Meeting of August 6th, 2018 and pursuant to the provisions of Section 5 of Nigeria Bar Association Constitution as amended, the issue was deliberated upon. This prompted a Motion to be moved on the issue, followed by a Counter Motion, resulting in general voting which recorded 24 “for” and 2 “against” DECLARING THE POSITION OF VICE CHAIRMAN OF IKORODU BRANCH VACANT. Following majority votes, the position of Vice Chairman was therefore declared VACANT.

It was also resolved by the General Meeting that subsequently, interested candidates for the Position of Vice Chairman and other vacant positions should make a formal Expression of Interest to the office of the Chairman of the branch before the next General Meeting of September 10, 2018 where elections was slated to hold for the vacant positions.

In order not to be found wanting, I complied with this directive but the opponent did not; instead, their nocturnal factional group busied themselves, exploring dubious means of smuggling in their candidate through the back door, without participating in a free and fair election. They insisted on my disqualification so that Mr. Ogbaide would be returned unopposed for the office of Vice Chairman, thereby trying to unlawfully impose an unpopular candidate on the branch.

To this effect, an Electoral Committee was constituted in anticipation of branch election on the 10th day of September, 2018. An election was indeed conducted on this day and I also emerged the winner for the position of Vice Chairman of the branch.

As typical of the factional group, seeing that their candidate has failed again, they jointly and severally petitioned the National Body, alleging that the Electoral Committee was biased and did not follow due process. Consequently, the 2nd Vice President, Mrs. Folake Dada was drafted to intervene into the matter. She came to the branch and carried out her investigation and reported her findings in the NEC Bundle of 6th December, 2018 and recommended that the disqualification of Mrs. Gloria Odibei- Cassius in previous contest was unlawful and for that reason, Mrs. Cassius should be allowed to contest for the position of Vice Chairman with Mr. Ezekiel Ogbaide, the candidate that was returned unopposed and other interested candidate in a bye election to be conducted according to the provision of the Uniform Byelaw to be monitored by the office of the 2nd Vice President.

To this effect, she directed that a branch Electoral Committee should be constituted in the next general meeting of the branch through nominations on the floor of the house. She however, confirmed that the National Executive Committee (NEC) of Nigeria Bar Association has adopted the Report which was read on the floor of the General Meeting attended by the said Mr. Ezekiel Ogbaide.

This recommendation however, did not go down well with Mr. Ogbaide and his cohorts whose phobia for open contest is undoubtedly overwhelming. They again petitioned the National Body on the 13th day of March 2019 accusing the 2nd Vice President of bias and favouritism, prompting the National Secretary ordering the Branch Chairman to stop the election slated to hold on the 15th day of March 2019.

The Branch Chairman’s attempt in an Emergency Meeting to persuade the Electoral Committee and other Excos to abide by this impromptu directive was met with stiff resistance. The Electoral Committee insisted on conducting election, which they did on the 15th March, 2019; and I also emerged the winner of the position of Branch Vice Chairman and to that effect, a Certificate of Return has been issued to me and on that mandate I stand.

Consequently, the branch Chairman, Mr. Bayo Akinlade, without the benefit of Fair-hearing in NEC Meeting at Abuja on the 28th March, 2019, lambasted, molested, humiliated and unlawfully suspended; while Mr. Ezekiel Ogbaide, a contestant for the disputed position of Vice Chairman, a position which was declared vacant prompting the re-election, was appointed Acting Chairman of the branch.
