It will be recalled that, Honourable Momoh and 14 of his colleagues had petitioned the Speaker of the House of Representatives, Honourable Yakubu Dogara to intervene in the crisis rocking the assembly. The House resolution was sequel to a motion of urgent public importance moved by Hon. Sunday Steve Karimi entitled “motion on the illegality in the Impeachment of the Kogi State House of Assembly” on the floor of the House”. While moving the motion, Honourable Karimi informed the House that on February 16, 2016, five out of the 20 elected members of the Kogi State House of Assembly in a commando style impeached the Speaker of the Assembly Hon Momoh. He also informed the House that Section 92 (2) (C) of the Constitution of the Federal Republic of Nigeria 1999 which provides that the Speaker or Deputy Speaker of a State House of Assembly shall vacate office if he/she is removed by a Resolution of the House or by votes of 2/3 majority of its members. He also told the House that five out of twenty-five members of the Kogi State House of Assembly had their elections nullified by the Court of Appeal and the Independent National Electoral Commission was yet to conduct fresh election into the House as at the time of the leadership crisis. According to him, the current Kogi State Governor Alhaji Yayaya Bello had threatened to remove Hon Momoh as Speaker and vowed to carry on legislative activities with the 5 lawmakers loyal to him as was done recently at the Ekiti State Assembly. To this end, he said that, 15 members of the Assembly loyal to the impeached Speaker were not allowed to enter the Assembly complex. He equally informed the House that the impeached Speaker’s official residence was invaded by armed Police officers acting under the governor’s directive. Contributing to the motion, Honourable Mojeed Alabi said that five members of the House cannot remove a duly elected Speaker, noting that the Constitution and the House rules had elaborate provisions on the process of removing a Speaker. Honourable Nnenna Elendu-Ukeje and Honourable Nicholas Ossai said that no one arm of government should interfere on activities of the other arm. When the motion was put to vote by the Speaker, Honourable Yakubu Dogara it was unanimously supported.]]>
