The Speaker was said to have been served the ‘Form 49 notice’ initiated against him by the appellant in the suit, Mr. Sylvanus Eruaga, through substituted means last week. Also ordered to appear before the court is the clerk of the House, Mr. Lawson Ugiagbe. The duo are to face contempt of court charge following their alleged refusal to comply with an earlier order of the court as contained in Form 48, notice of consequence of disobedience of court order directing them to swear in Mr. Eruaga as the representative of Etsako West II in Edo State House of Assembly. It will be recalled that the Appeal Court had last week granted the appellant leave to serve Form 48 on the Speaker and the Clerk of the House through substituted means after the court bailiff was allegedly beaten up in the Speaker’s office, to indicate why an order of committal to prison should not be made on the two (speaker and clerk) in suit CA/B/93/2016. The order, read: “Take notice that the judgment creditor/applicant will on March 21, 2016, at 9a.m., apply to this court for an order for your committal to prison, for having disobeyed the order of this court made on December 19, 2015 requiring you to swear in the judgment creditor/applicant as the member to represent Etsako West constituency in the Edo State House of Assembly and despite the service of form 48 (notice of consequence of disobedience of court order) on you on March 5, 2016.” Contacted on phone by newsmen, the speaker, Mr Edoror said: “I am not aware of that.
