Maina had last year filed a suit at the court asking it to declare as null and void, the EFCC Act of 2004 on the grounds that Act did not follow proper legislative processes before becoming a law, hence he is asking the court to declare the EFCC law as a nullity. But at the resumed hearing of the case on Monday, counsel to the EFCC told the court that they were not served with the originating process, and however requested for a new date to enable him adopt all the processes and written addresses. Maina went to court after he was declared wanted by the EFCC for allegedly diverting recovered pension funds while serving as chairman of the pension reform task team. Listed among the four respondents in the suit are – the EFCC, the AGF, the Senate President, Bukola Saraki and Speaker of House of Representatives, Yakubu Dogara. He is also asking the court to refrain any security agency from arresting him over allegations of corruption.
