The Bauchi division of the Federal High Court had, in December, 2015, citing lack of jurisdiction, struck out a suit challenging the eligibility and candidature of Governor Abubakar. The case at the Appeal Court was filed by an All Progressives Congress (APC) governorship aspirant, Abdullahi Muhammad Tanko Ningi, challenging the election of Abubakar as the winner of the APC gubernatorial primary election in Bauchi. Ningi is alleging that the gubernatorial primary was marred with “over voting, substitution of party officials sent for the conduct of the election as well as violation of the APC guidelines among others.” The plaintiff, therefore, was asking the court to annul the election of Abubakar, and in turn, declare him (Ningi) as the eligible winner of the primary, and also order the Independent National Electoral Commission (INEC) to declare him as the governor of Bauchi State. The panel of three judges, led by Justice Adzira Gana Mshelia, yesterday adjourned the matter to Wednesday June 15, 2016, for hearing. ]]>
