The candidate of the All Progressives Congress, Chief Anthony Adeniyi, had urged the court to nullify the victory of Olujimi because she did not duly resign as a member of the National Communications Commission board at the time she contested. The APC candidate in Ekiti Central, Gbenga Olofin, alleged that the election was marred by violence, corrupt practices and that Rasaki was not validly elected by lawful votes cast at the poll. The Peoples Democratic Congress and its candidate, Lawal Olutunde, who also filed petition against the election of Rasaki also claimed that they were wrongfully excluded from participating in the senatorial poll. Delivering judgment in the appeal filed by Adeniyi, panel chairman Justice Sidi Bage held that Olujimi was eligible to contest having resigned her appointment as a board member of NCC within the 30 days allowed by the Electoral Act 2010 (as amended). According to him, the stamp and date on the resignation letter of the PDP candidate showed that it was dated February 26, 2015 while the election held on March 28, 2015. Bage also ruled that all the votes credited to the PDP candidate remain valid as the second appellant (APC) admitted that its candidate came second in the election. The court also dismissed a separate case filed by the APC against Olujimi challenging her eligibility to run for the Ekiti South senatorial seat. Dismissing the appeal filed by Olofin, the court in a judgment read by a member of the panel, Justice Chinwe Iyizoba, held that the evidence of the appellant’s witnesses were full of hearsay and could not be relied upon. The judge held that for Olofin to prove his case beyond the reasonable doubt, he must lead evidence unit-by-unit and ward-by-ward to prove that there was over-voting. Iyizoba ruled that hearsay evidence was inadmissible in law holding that the appeal lacked merit and is accordingly dismissed. Dismissing the appeal filed the PDC and its candidate against Rasaki, a member of the panel, Justice Yargata Nimpar, who read the judgment, said the appellants failed to prove their case and the appeal lacked merit.]]>
