The accused persons were alleged to have assaulted the officials with blows and throwing stones at them while they were on uniform performing their official duties and thereby committed offence under 259(a) of the Criminal Code Cap 30, Vol 11 Law of Enugu State of Nigeria. According to C. O Ugwu, the police prosecutor, the accused persons, on July 15, 2015, along Chime Avenue, New Haven, Enugu, conspired among themselves to attack Eze Michael and Eze Sunday, enforcement officials of the State’s Ministry of Transport. The prosecutor said that the offence is punishable under section 495 (a) of the Criminal Code Cap 30 Vol. 11 Laws of Enugu State of Nigeria. The accused pleaded not guilty to the charges. Chijioke Eze Esq, the defense counsel urged the court presided over by His Worship Linda Okaibe to grant them bail in liberal terms. He told the court that the charges against the defendants was bailable and assured the court that they will provide a reasonable surety as well as make themselves available for trial.
