With the system operated in the Nigerian legal System whereby a legal practitioner can practice anywhere in the country, a lawyer can travel all the way to Sokoto, Kaduna or any other Northern State from a southern part of the country and vice versa just to announce appearance/handle a case. This involves the spending of money and injecting of energy which will definitely be weighted on the parties. However, what then will be the fate of a party after he or she fails to even announce appearance simply because the court did not sit without prior notification? Your guess is as good as mine. Many Lawyers have experienced this situation and there have been some arguments on how to solve the problem once and for all. Some have argued that the judiciary by convention should start compensating such litigants, while others have argued that there should be a Law compelling the Judiciary to compensate litigants and counsels on such cases of disappointment. What do Lawyers think about this? Is a Law actually necessary for such a purpose?
