The ACC’s conduct when it decides to investigate allegations of corruption must be beyond reproach, and it should always act in a way that is independent, impartial and lawful, acting judge of appeal Kate O’Regan cautioned in a judgement on an appeal by Hailulu against a High Court decision in which he scored only a partial victory against the ACC in July 2013. It is a matter of grave concern that Judge President Petrus Damaseb found in his judgement three years ago that, by arresting Hailulu in November 2008, the ACC advanced the cause of a trade union that was locked in a dispute with the NHE over a restructuring exercise at the parastatal, judge O’Regan commented in the Supreme Court’s judgement. “Such conduct is deplorable, and [Hailulu] is entitled to feel aggrieved by it,” she stated.
