The presiding judge, Justice Rukayat Ayoola said the impeachment did not follow the procedure as required by the constitution in section 182, describing the process null and void. She said the complainant was denied of the benefit of fair hearing, describing the impeachment as an affront against the principle of natural Justice and rule of law. Ayoola, while given a declarative judgement saying, Hon Muhammed Ali should be reinstated as the chairman of Dekina Local Government Area immediately. The Court said Ali, was equally entitled to his executive benefits while he was out of office as a result of the purported impeachment. It would be recalled that five out of the 12 councillors of Dekina Legislative council carried out a purported impeachment on the executive chairman of Dekina Local Government Area on the 24th of September, 2014 on the allegation of abuse of office. Hon Mohammed Ali challenged the impeachment at the kogi state high court Anyigba, praying the court to set aside the purported impeachment that he was innocent of the allegations. The court entertained the case first of all on the 10th of October, 2014 and delivered its judgement on the 12th of February, 2016 after several sittings. ]]>
