Justice Nasiru Saminu of Kano state High Court of justice sitting at Danbatta has struck out the case instituted by the Kano state chapter of the Motion Pictures Practitioners Association of Nigeria (MOPPAN) against the state censorship board for lack of diligent prosecution.
Joined as co-defendants in the case were the Kano state censorship board, Kano state Attorney General and commissioner for justice, state’s commissioner of police, Director DSS Kano state, AIG zone 1 and Hamisu Lamido Iyantama who is the chairman film distribution committee set up by the state censorship board.
Delivering his ruling today, Justice Saminu said the plaintiff showed lack of interest in the case as they consistently failed to appear in the court during proceedings.
Counsel to first and second defendants, Bar. Wada Ahmed Wada told our reporter that for the second time the applicants had failed to appear in court for the prosecution of the case hence the decision of the presiding Judge to dismiss the case.
“The case was adjourned from 14th March for today for hearing of their application which they brought to court for enforcement of their fundamental human rights but when we went to court today unfortunately they were not in court for the second time. Neither their counsel nor any of the five applicants they were not in court.
“Their cousel only called and said he had some faults with his car without finding it worthy to write to the court or the court registrar informing him of that because ordinarily under the procedure of court if you have any issue that could prevent you from coming to the court as a lawyer or as a litigant you write to the court of the registrar of the court informing him of your predicaments but he didn’t do so and he was aware of today’s sitting, there was prove of service of hearing notice, he was fully aware that the case is coming today and the applicants were also aware but they were not in court, so based on that the presiding judge Justice Nasiru Saminu in his ruling delivered today ruled that from today he has dismissed the suit for lack of diligent prosecution” he said.
