However, upon the inauguration of the present EXCO, the Congress under the leadership of the present chairman JK Ishember Esq, on the same day at the same meeting, nullified the adoption, and then, mandated the Electoral Committee NBA (ECNBA) Makurdi branch to conduct fresh election for the office of NEC Rep as stipulated under the NBA Constitution 2015. The ECNBA Makurdi branch made up of five members immediately called for the nominations of candidates. Two aspirants obtained the nomination forms, that is, EZ Agbakor Esq and MM Ikwulono Esq. The Nigeria Lawyer was informed that a statement from George Usongo, a member of the ECNBA disclosed that: “the committee resolved that since the EXCO want strict compliance with the constitution, they will follow it stricto sensu in the bye election and this was to include eligibility of aspirants, their nominees, and voters.” It was also gathered that the ECNBA Makurdi commenced screening on 11th July 2018, where one of the two aspirants was successfully screened while the other had issues relating to attendance of meetings and eligibility of nominees, but the committee was patient with that aspirant and adjourned for one week to 18th July 2018 to enable the aspirant put the records in order. Yesterday, 18th July, 2018, it was alleged that the ECNBA Makurdi after a resumed sitting, rolled out a notice stating that both aspirants were successfully screened and cleared to contest the position of NBA Makurdi Branch NEC Rep. This notice sparked off controversy as one of the members of the ECNBA Markurdi, George Usongo Esq, stated that not all the two aspirants met the constitutional requirements to contest the election. It was further alleged that George Usongo accused the chairman and secretary of ECNBA Makurdi of insisting on successfully screening the aspirant despite the obvious failure of the aspirant in fulfilling the conditions for a successful screening exercise. He added that in spite of a majority of 3:5 votes against the aspirant’s screening, the Chairman and Secretary went ahead to waive the strict application of the NBA Constitution in favour of the aspirant on the grounds that there is substantial compliance. In response to the accusation, the Secretary of the ECNBA Makurdi stated that Mr. George Usongo Esq was not present at the last meeting and that the committee sat and made resolutions that both candidates are qualified to contest the election. The Secretary, however, did not disclose details on how the resolution was arrived at, but, said that will be done when the committee is called upon to do so at the Branch meeting.]]>
