Mr. Dasuki, arraigned before Justice Adeniyi Ademola, on allegations of unlawful possession of firearms, told the court that the State Security Service lacked the moral or legal standing to continue detaining or prosecuting him, since they have neglected the orders of the court, granting him bail. Counsel to the formal NSA, Joseph Daudu, in an application dated February 16, asked the court to order his clients to release Mr. Dasuki, and halt proceedings till when the prosecution obeys an initial order by the same court, granting him bail. Mr. Daudu added that section 36 of the Administration of Criminal Justice Act, ACJA, presumes his client innocent until proven guilty by a court of law. He said the refusal of the prosecution to obey court order, amounted to a contempt of court. Counsel to the SSS, Oladipo Okpeseyi, however argued that the application lacked merit as it was solely intended to frustrate the proceedings in court. Mr. Okpeseyi, who noted that Mr. Dasuki and his lawyers had been denied a similar application at a sister court, added that there was nothing in the bail order granted Mr. Dasuski which prevented him from being rearrested in the event of a recent development. Mr. Okpeseyi therefore prayed the court to dismiss the application for lacking in merit. The case was adjourned till April 4 for ruling.]]>
