The Chief Magistrate, Mrs Caroline Oghuma, who ordered the remand, said that the case file should be duplicated and sent to the Directorate of Public Prosecution (DPP) for legal advice. Oghuma remanded the accused at Oko Medium security prison, Benin, pending the advice of the DPP, and adjourned the case till Nov. 18 for mention. Prosecutor Oluwaseun Olatoye told the court that the accused committed the crime on Sept 3, at No 40, Enoruwa Str., Off Upper Sakponba Road, Benin. Olatoye said the accused unlawfully killed Blessing Obazee his in-law by using a knife to stab him on his stomach severally. He the accused came to stay in the same room with the deceased, his in-law, in his house. The prosecutor said that on that faithful, Obazee refused to give the accused the cigarette he was smoking, and later the accused went to buy his own. Olatoye said that the deceased resisted the accused from smoking in his room, and during a scuffle Igbineyi took a knife and stabbed Obazee severally to death. The prosecutor said the offence contravened Sections 319 (1) of the Criminal Code Cap. 48 Vol. 11 laws of the defunct Bendel State of Nigeria 1976 now applicable in Edo. (NAN)]]>
