Delivering judgement, the Chief Judge of the state, Justice Umaru Dikko, ordered the APC to pay the money as well as 10 per cent interest on judgment sum and cost of filing the suit. He said the judgment was based on Order 15 rule 4 of the state High Court procedure which said “when it appears that the defendant has no good defence, the judge may proceed to deliver judgment in favour of the plaintiff.” Justice Dikko said the defendants were served courts processes but there was no notice accompanied with an affidavit to state their defence, adding that if defendants had filed a notice to the court, the court would have granted them leave to defend their case in line with Order 15 rule 3 of the court procedures. It will be recalled that a team of lawyers filed a case before the court, following an alleged breach of contract by the APC in March 2014 to file and defend petitions for and against the party in the state’s Local Government Elections Petition Tribunal after the local government elections for the sum of N100 million as professional fee. The team of lawyers requested the party to pay N75 million as part payment for the job but the party allegedly paid N7.3 million on installments leaving a balance of N92.7 million.]]>
