The family had dragged the occupant of the land situated at KM 50 Lagos-Abeokuta Expressway, Sevan Construction Nigeria Limited before the court claiming ownership of the said land and praying the court for an order of possession, as well as a perpetual injunction restraining the defendant. After series of hearings, Justice O. Ogunfowora held that the claimants were the rightful owners of the land and therefore were entitled to a statutory right of occupancy. The court admitted evidence of the claimants which showed the family history of ownership of the land from the first settlers, Afiroko and Subotun who migrated from Olota family house in Ago Oko in Abeokuta. The court also heard evidence that the first settlers were the forefathers of the present Adebiyi family. Justice Ogunfowora also held that based on the testimonies and documentary evidence before the court, it was clear that the Adebiyi family were the rightful owners of the parcel of land in question. The court ordered Sevan Construction Nigeria Limited to stop all acts of trespass on the land. The case was instituted on behalf of the Adebiyi family by principal members including Reverend Joseph Olusanjo Adebiyi, Joseph Olujimi Adebiyi, Yekini Busari, Biliaminu Busari and Sunday Adebiyi.]]>
