Two chieftains of the All Progressives Congress (APC) in Yobe State, Ayuba Sabo, and Ahmed Abubakar, were challenging Gaidam’s eligibility to contest the April 11governorship election in the state, claiming he has already served for two terms. However, counsels to Gaidam and the Independent National Electoral Commission (INEC) were absent in court, and no formal letter was written to the judge as demanded by the rules. Justice Ahmed Mohammed, in his ruling, warned that he would not “tolerate any further delay on the part of the defendants in this case.” Gaidam served as former deputy to late governor Mamman Ali from May 29, 2007, to January, 2009 when he became governor, following the death of Ali. He was later sworn-in as elected governor on May 29, 2011. The applicants were seeking, among other reliefs, a declaration that the governor, having taking oath of office on two previous occasions, was no longer eligible to contest the 2015 governorship election, based on the provisions of sections 180(2)(b), 182(1)(b) and 191(1) of the 1999 Constitution. The judge has adjourned the case to November 3 for hearing. He ordered that fresh hearing notices be served on the parties.]]>
