The judge, Mr. Shekarau Ibrahim, struck out the case and discharged Lucky of the alleged offence as the nominal complainant, Titus Mkarga, had no interest on the case anymore. “Since the nominal complainant has indicated that he has no interest in the case, based on the fact that the accused had pleaded with him, asked for forgiveness and had written an undertaking. “I hereby invoke Section 165 of the Criminal Procedure Code to strike out the matter and discharge the accused for lack of interest by the complainant,” the judge said. The judge, however, advised Lucky to desist from criminality in the future and strive to engage in productive venture. He also told him to associate with people that can make positive impact in his life and with those he can benefit from. At the resumed hearing, the prosecutor, Cpl. Donald Heman, told the court that the accused had settled with the complaint He said that Mkarga, of Calvary Road, Mararaba, reported the case at the ‘A’ Division Police Station on April 28. Heman alleged that the accused and two members of their gang, one Prince Lucky and Michael, now at large, conspired to commit the crime. The prosecutor said that Lucky and his members beat up the complainant. “As a result of the beating, MKarga sustained injuries on his right eye and right hand,’’ the prosecutor said. He had told the court that the alleged offences contravened Sections 97, 316, 248 and 265 of the Penal Code. Lucky had pleaded not guilty to the charges.]]>
