An Osogbo High Court, on Tuesday, fixed October 5 for further hearing in a suit filed by Justice Folahanmi Oloyede against the speaker of the House of Assembly and 10 others.

Justice Adeyinka Aderibigbe, who gave the order, said the adjournment was to allow the counsel to the plaintiff, Mr Kanmi Ajibola, to serve the third to ninth respondents duly.

Ajibola had told the court that it was difficult to serve the third to ninth respondents, saying he had an ex-parte application dated September 11 to allow for thorough service on the respondents.

He said other respondents were properly served and urged the court to adjourn the case on the basis of the application to enable him and his colleagues to respond to the processes received from the defence counsel.

Earlier, the defence counsels, Lawal Ibrahim and Idris Mikail, had tendered two applications before the court at the sitting.

The application contained a counter affidavit to show that the complainant was not truthful in fair hearing, in spite of her proxy and also an application seeking the court to dismiss the case on grounds of baseless fact and improper service.

The News Agency of Nigeria (NAN) reported that Oloyede, a serving judge in the state, had sent a petition to the assembly, calling for the impeachment of Governor Rauf Aregbesola for alleged financial recklessness.

The assembly, however, dismissed the petition on August 4 following the recommendations of a seven-man ad hoc committee set up to investigate the allegations.
