Ojiah who operated the garden at Awolowo Road, Area 8, Garki District, FCT, alleged that, the defendant built unapproved structure in the garden. The petitioner who was represented by her lawyer, Esther Uzoma at the sitting of the tribunal in Abuja on Friday alleged that the defendant cut down the trees planted in the garden. She alleged that the defendant uprooted the bananas trees in the garden and removed the wires used to secure it. Uzoma alleged that the defendant also converted a portion of the garden to car wash thereby creating water log within the recreational centre. She said the “soap water’’ from the car wash was also harmful to plants and flowers in the garden. The petitioner asked the tribunal to award N5m damages against the defendant for the destruction of the economic trees and the wired fence. She urged the tribunal to stop the defendant from using the premises as car wash. The petitioner also demanded the immediate eviction of the defendant and other operators of the illegal lock up shops in the garden. Meanwhile, the Chairman of the tribunal, Mr Oluseyi Lufadeju has admonished the defendant from deliberately delaying hearing in the petition. The warning was sequel to the complaint by the petitioner that the case had been adjourned severally at the instance of the defendant.
